§ 1. General Provisions
The online store operating at www.quarelli.com is run by Decorpigment
Patryk Sperczyński, with its registered office at ul. Armii Krajowej 31, 58-150 Strzegom, Tax ID: 7492091063.
These Regulations define the rules for using the Online Store, placing orders for
products available in the Store, delivering ordered products to the Customer, paying by the Customer
the sales price of products, the Customer's right to cancel an order and withdraw from the contract, and
the rules for submitting and handling complaints.
The Regulations apply to both Consumers and Entrepreneurs using the Store,
taking into account legal provisions granting special rights to individuals
entering into a contract directly related to their business activity (Entrepreneurs with consumer rights).
§ 2. Definitions and product specificity
Customer – a natural person, legal person, or organizational unit without legal personality,
to whom the law grants legal capacity, making purchases in the Store.
Consumer – a natural person making a legal transaction with an entrepreneur not directly related
to their business or professional activity.
Specialist (Sensitive) Products – resins, microcements, primers, and
acrylic dispersions offered in the Store. Due to their specific physicochemical properties, these products require
strict storage conditions and are extremely sensitive to temperature fluctuations (in
particular, freezing below 5°C or overheating above 25°C).
Accompanying Products – the remaining assortment of the Store not being Specialist Products (including
in particular tools, tapes, buckets, workwear, and construction accessories), which does not
show thermal sensitivity.
§ 3. Right to withdraw from the contract (Returns)
In accordance with the Act of May 30, 2014, on consumer rights, the Consumer and the Entrepreneur
acting with consumer rights have the right to withdraw from a distance contract within 14 days
without giving a reason, subject to the exceptions indicated in paragraphs 2 and 3 of this section.
Exclusion of the right to return Specialist Products:
Given Article 38(1)(5) of the Act on consumer rights, the right to withdraw from the contract does not
apply to resins, microcements, primers, and acrylic dispersions purchased in the Store.
Due to health protection and chemical and quality safety reasons,
these goods, after leaving the Seller's warehouse and breaking the chain of supervision over cooling/thermal
conditions, are not suitable for re-sale. There is a justified risk that
improper storage by the Customer (e.g., leaving the product at freezing or too high temperatures)
has permanently damaged the bonding properties and structure of the product, making its re-verification
of quality impossible.
Exclusion of the right to return personalized products:
In accordance with Article 38(1)(3) of the Act on consumer rights, the right to withdraw from the contract does not
apply to goods whose color or properties have been mixed, tinted,
or prepared upon individual order and according to the Customer's specifications.
Conditions for returning Accompanying Products:
The right to withdraw from the contract and return the goods within 14 days is reserved only for
Accompanying Products (tools, accessories, etc.), provided that these products show no signs of
use, are complete, and are in their undamaged original packaging.
NOTE: Due to the restrictive thermal requirements of our products (resins,
microcements, primers, dispersions) and the fact that colors are mixed upon individual request –
returns of full-value goods from these categories are not accepted.
§ 4. Return procedure (for Accompanying Products)
To exercise the right to withdraw from the contract regarding Accompanying Products, the Customer
must inform the Seller of their decision by a clear statement (e.g., a letter
sent by mail or e-mail) within 14 days from the date of taking possession of the goods.
The Customer is obliged to send the product back at their own expense to the address: Decorpigment Patryk Sperczyński, ul.
Armii Krajowej 31, 58-150 Strzegom.
The Seller will refund the payment using the same payment methods as used by the Customer, within
14 days from the day of receiving the returned goods or proof of their dispatch.
§ 5. Complaints (Non-conformity of goods with the contract)
The exclusion of the right to return without giving a reason, referred to in § 3, does not in any way limit
the Customer's rights to file a complaint if the goods (including resin, microcement, primer, or
dispersion) have manufacturing defects, are non-compliant with the contract, or were mechanically damaged during
transport.
Complaints should be submitted in writing to the company's registered office address or electronically to the Store's email
address.
The complaint notification should include the Customer's data, order number, description of the defect, and
– if possible – photographic documentation.
The Seller will respond to the Consumer's complaint within 14 days from the date of its receipt.
§ 6. Final Provisions
For matters not regulated by these Regulations, the relevant provisions of Polish law shall apply,
in particular the Civil Code and the Act on Consumer Rights.
These Regulations come into force on the date of publication on the website www.quarelli.com.
